Coroner Rules In-Custody Death Homicide

What allegedly began as a domestic dispute ended with one man dead following a struggle with sheriff’s deputies.

Kern County supervising deputy coroner John Van Rensselaer said Thursday that 25-year-old Rory Romal McKenzie's death was a sudden death during restraint by police.

Rensselaer said the manner of death is homicide.

There is no word yet on the status of the deputies involved.

On July 2 around 12:45 a.m., a woman flagged down a deputy in east Bakersfield and said she had been assaulted by her husband, Rory McKenzie, 25, the Kern County Sheriff’s Department reported.

The woman told ABC23 that she was arguing with McKenzie, who then broke her car window with a baseball bat.

She said that she led deputies back to their house on Feliz Drive and gave them a key to enter. When deputies made their way into the home, McKenzie started fighting with the deputies, the KCSD reported.

A Taser was used to subdue McKenzie, but he still continued to fight, deputies said. A K-9 bit McKenzie on the leg, allowing the deputies to then take him into custody, KCSD reported.

After McKenzie was handcuffed, deputies said, they noticed that the man was having a hard time breathing. Deputies said they removed the handcuffs and performed CPR on McKenzie.

An ambulance arrived and took McKenzie to Kern Medical Center, where he died.

In July, McKenzie's wife accused the deputies of using excessive force, but would not say if she is filing a formal complaint.

The deputies involved were:
Sgt. Otis Whinery, a 24-year veteran.
Senior Deputy Douglas Jauch, K-9 Handler, an 8-year veteran.
Deputy Edward Tucker a 12-year veteran.
Deputy Patrick McNeal, a six-year veteran.
