Controversial Sludge Ban Overturned

Federal Judge Rules Los Angeles Can Dump Sludge In Kern County

POSTED: 8:24 am PDT August 14, 2007
UPDATED: 5:56 pm PDT August 14, 2007

Los Angeles can once again dump its sludge in Kern County after a federal judge ruled Kern County's sludge ban was unconstitutional.

Voters had approved Measure E, which banned outside areas from trucking their sludge into Kern County.

The judge ruled the measure unfairly targeted out-of-county sludge ventures, allowing only in-county business.

The judge also ruled the measure violated state recycling laws.

State senator Dean Florez, who championed Measure E has called a press conference for Tuesday morning to respond to the ruling.
