Accused Animal Hoarder Off To Mental Hospital

An accused animal hoarder and abuser will be sent off to a state mental hospital after she was found incompetent to stand trial.

Wednesday morning, Cynthia Gudger found out she will not be forced to take involuntary medications and will be sent to the Patton State Hospital as soon as there is a bed open for her.

Gudger’s defense attorney said there is a long waiting list for the hospital, so Gudger may stay in jail for a while longer.

Gudger faces 10 counts of animal cruelty after she was found living with dozens of sick, dying and dead animals in her Tehachapi home.

In March, Gudger was found incompetent to stand trial due to an undisclosed disability.

As soon as Gudger is transferred to Patton State Hospital, she will be treated until she is found competent to stand trial, but doctors did not recommend involuntarily medications.

Michael Yraceburn, Supervising Deputy District Attorney, said, "It's an ongoing process with (the hospital). It uses a multi-team approach at Patton to evaluate her at continuing levels."

Michael Lukehart, Gudger's Defense Attorney said, “They often recommend that people be involuntarily medicated if they think that'll help. The doctors here don't think that's the underlying problem, so they didn't recommend it."

Judge Michael Bush ruled Wednesday that Gudger is not to spend more than three years at Patton and that time includes the more than 180 days she has already spent in jail.

Wednesday Gudger attempted to recuse her lawyer once again, but Bush denied her request.

Gudger continues to insist she is competent to stand trial, and says she does not need to be treated.

The attorneys on the case say if Gudger is not placed at the hospital within 60 days, they may have another hearing to try and move her up on the waiting list.
