Man Sentenced To Life Without Parole In 4th Of July Killing

The man convicted of murder in a July 4th killing from 2007 was sentenced to life without parole plus an additional sentence of 25 to life in prison Wednesday morning.

Tomas Vasquez was convicted in the murder of David Timberlake who was shot to death on H Street in 2007.

On July 13, 2007, the Los Angeles County Sheriff's Department arrested Vasquez in Pico Rivera after BPD detectives learned of a relative's address.

Vasquez was brought back to Kern County on July 13, 2007, and booked into the jail on charges of murder, robbery and conspiracy to commit a crime.

Police said that there were a total of four people including Vasquez involved in the crime.

Previously, Michael Aguirre, 18-year-old Gregory Aguilar and a 16-year-old girl were arrested and charged in Timberlake's murder.

Gregory Aguilar pleaded no contest to second-degree robbery and voluntary manslaughter on Sept. 18, 2009 and is serving 12 years in Wasco State Prison.

On Wednesday in the courtroom, there were several confrontations -- as different people tried to make statements about the crime.

Timberlake's sister, Jessica Timberlake said, "My brother was a family man. He had a daughter and his wife was pregnant. There are two little girls now that will never have a father."

During Jessica's speech, Vasquez said, "(expletive) you (expletive)," which started a commotion in the courtroom.

Vasquez's mother, Demille Tokich wanted to give a statement in the courtroom, but Vasquez declined her rights and said that he didn't wish for her to make a statement.

Tokich told ABC23 outside the courtroom that, "(Vasquez) is not an angel, nobody is. The people he was with (during the shooting) only knew (Vasquez) for 30 days. They were using him as a scapegoat."

A very emotional Julia Timberlake, David Timberlake's mother said, "What this man did destroyed my life. I now live in fear everyday."

Julia continued, "I now cry every night because of what this man did."

ABC23 spoke with Tokich and she said that she cries every night as well, but she has faith and hope and she will never give up on her son.

Timberlake's family said they are relieved Vasquez will spend the time behind bars.

Vasquez's mother said she will do everything possible to try and overturn his sentence.
