Murder Charges Against Deputies May Be Dropped
BAKERSFIELD -- Defense attorneys for three detention deputies charged with the murder of an inmate said an independent examination has vindicated their clients, and they will push for a dismissal.
A report by Dr. Paul Herrmann, a forensic pathologist and medical-legal consultant, claims that James Moore died from a carotid artery hold that was inappropriately applied during one of many struggles between Moore and detention deputies on August 5, 2005.
Daniel Lindini, Ralph Contreras and Roxanne Fowler have been charged with second-degree murder.
Dr. Herrmann made reference to evidence of blunt force trauma in his report, but said that in his opinion, death was due to obstruction of his airway due to a damaged larynx from the choke hold.
The District Attorney's office Tuesday disputed Herrmann's findings, saying they were not consistent with the results from the coroner's office.
The defense will ask the judge to dismiss the case during a motion hearing in November.
The trial date was pushed back to March of next year.
