Police report: 17-year-old shot and killed stepfather after an argument about grades

New details have been released by the Bakersfield Police Department regarding the fatal shooting of 37-year-old Derick Mitchell.

According to the police report released today, officer Valeria Robles entered the home on the 8900 block of Cinnabar Court just after 7:30 p.m. on June 25, 2014. Officer Robles entered a room where 17-year-old Kody Mitchell was lying in the fetal position on the carpet with blood on his t-shirt, hands, arms and legs.

Officer Robles said Mitchell was sobbing and said, "It was just an argument. I was only trying to scare him. So I grabbed the gun in the dresser. I didn't know it was loaded. Why was it loaded? I didn't mean to shoot him."

Mitchell's mother said in the report that before the shooting occurred, she threatened to take her son's cell phone away and ground him due to failing grades. Mitchell allegedly walked in to the bedroom where Derick Mitchell followed him,

Bakersfield police said that when they arrived, they found 37-year-old Derick Mitchell with a single gunshot wound to his chest.

Officials said the wound was inflicted by Mitchell during an altercation. Sergeant Joe Grubbs from the Bakersfield Police Department says this was not a suicidal intervention.

The teen has been arrested and charged with murder.

Mitchell died about an hour after arriving at the hospital.

The incident is still under investigation.
