OILDALE, Calif. - Friday morning Sheriff deputy John Swearengin is expected to make his first court appearance after killing two pedestrians with his patrol car.

Swearengin faces two felony counts of vehicular manslaughter with gross negligence.

According to an internal investigation made public earlier this month, Swearengin was speeding over 80mph when he hit the two pedestrians that were pushing a motorcycle on Norris Road around 7:30 p.m. on Dec.16, 2011.

According to the report, if Swearengin had been going the posted 45mph speed limit, the couple would've had time to get out of the way.
