Howard's attorney, Mark Raymondo, said that Howard was already technically in custody serving in the "Baby and Me" program when a warrant surfaced for a separate, older charge.

Raymondo said she was doing well in the program and that officials knew she was in the program and were the ones who put her in the program.

Raymondo told 23ABC that Howard has been separated from her child for three days and is very upset.

Raymondo said that Howard's case was filed mid December and that's when the warrant was issued. Howard had been a part of the program since the summer.

The warrant was related to drug charges.

Raymondo said Howard was on the departments ankle monitoring program and was doing exceptionally well.

Howard's bail was originally set at $92,000 and dropped to $25,000 and Raymondo said he hopes that she can get out and be reunited with her child.

Raymondo said the program is fantastic for woman who have drug problems to help them get their lives straight and spend time with their children.
