The case against a Vineland Elementary first grade teacher charged with possession of child pornography was declared a mistrial. 

Margarito Madueno was arrested in October of 2015 after KCSO deputies from the Lamont substation say they found child pornography on the 34 year-old's computer.

Defense and prosecution will return to court this Thursday to set a new trial date.
