The officer who opened fire and killed a man in April has been cleared by the department's incident review board.
47-year-old Rogelio Landa was driving with two other people in his car when police attempted to pull him over. They were looking for suspects involved in two robberies.
The suspects attempted to drive away and crashed into a tree. Landa then got out of his car to run from police. That's when a Bakersfield police officer shot him.
Investigators found an airsoft gun inside of the suspect's car, identical to the one seen in surveillance footage at one of the locations that were robbed.
The department determined that the shooting was justified and now has to go through the district attorney's office.
