A court case revolving around Tastries Bakery and a same-sex wedding cake will likely be heading to the state level after a Kern County judge entered his final judgment this month.

Kern County Superior Court Judge David Lampe issued his final judgment on May 1 denying the State of California's request to either force Tastries owner Cathy Miller to design custom wedding cakes for same-sex couples or not create wedding cakes at all, according to her defense team at the Freedom of Conscience Defense Fund.

Lampe officially ruled in favor of Miller back in February.

The State's Department of Fair Employment and Housing, who brought the suit against Miller, is likely to appeal the final judgment in addition to its appeal of the initial denial of its motion for preliminary injunction, according to Miller's defense team.
