BAKERSFIELD, Calif. — Several people were seen exercising at the Strength and Health gym in Downtown Bakersfield Tuesday.

The facility has reopened ahead of state approval, defying the Kern County Public Health Services Department, once again.

In April, a citation from the Bakersfield Police Department was issued to Mark Pacheco, the gym's owner, following multiple warnings from public health officials.

Pacheco argues he's not doing anything wrong and by allowing the community to exercise and further their health.

"I'm doing a thousands times more to provide good health by running a health and fitness center that promotes good health and nutrition," Pacheco said.

The operation of the business appears to be occurring under the radar.

A sign on the front door says "closed," and the door is locked.

But, according to Pacheco, vehicles park in the back and gym members now enter from the side door.

Public Health has not confirmed wether they are aware of the gyms operations.
