The four-year-old boy from Ohio pictured in police photos in the back seat of a car while two adults were passed out will be moving to South Carolina with his great uncle and great aunt.
A judge granted the relatives custody of the boy on Monday after they petitioned the court.
The boy's grandmother, Rhonda Pasek, was found slumped over along with her boyfriend, James Acord, from a drug overdose earlier this month.
Pasek had been granted custody of the boy six weeks ago. She is now being held on a child endangerment charge.
Acord pleaded guilty to child endangerment and operating a vehicle while intoxicated.
