John Giumarra III's defense team asks case be delayed

UPDATE (October 26, 2017 11:10 a.m.): According to John Guimarra III's defense attorney the defense team asked for his case to be delayed. The prosecution did not oppose it. 

The attorney told 23ABC the defense team asked for the case to be pushed back from October to sometime in January in order to "conduct additional discovery". 

The delay is related to the team waiting for results of a calibration test for the breathalyzer used on Guimarra.

John Giumarra III, the man accused of hitting and killing a woman while he was allegedly driving under the influence, is set to be in court Wednesday morning. 

Back in January, Giumarra was allegedly driving under the influence with a blood alcohol level of 0.18, more than twice the legal limit, when he hit and killed 32-year-old Angela Holder in the area of Golden State Highway and F Street. 

Giumarra faces DUI and hit and run charges.

He's set to be in court at 9 Wednesday morning.
