Jared Fogle victim drops federal lawsuit

INDIANAPOLIS -- Former Subway pitchman Jared Fogle will not have to return to the federal courthouse in Indianapolis after one of his victims decided to drop her complaint Thursday, according to documents obtained by Indianapolis-based WRTV.

The attorney for the victim, Mike Stephenson, would not comment on the decision and said the federal filing spoke for itself. The paperwork was filed on Thursday and means this case against Fogle is over, though other victims could pursue their own complaints.

The dismissal comes one week after Fogle's attorney filed paperwork showing what exhibits and witnesses he planned on using in a potential trial.

Fogle planned on blaming the parents for the victim's alleged depression in a counter suit. Their intent was to prove that the girl's parents failed to properly supervise their daughter, which caused her to engage in harmful behavior.

The counter suit came after the victim, known as Jane Doe, filed a lawsuit against Fogle and his former business partner, Russell Taylor. She claimed after she discovered she had been secretly filmed by Taylor, that she fell into depression, considered suicide, slept with multiple people and turned to drinking and drugs.

Fogle is currently serving more than 15 years behind bars at Colorado's Englewood Prison.

An appeal by Fogle to lower his prison sentence was denied in June by the 7th Circuit Court of Appeals in Chicago.

Fogle could still appeal the ruling to the U.S. Supreme court.
