NJ woman who claims husband was fired for passing gas has lawsuit dismissed

Louann Clem claimed her husband was fired from the Case Pork Roll Co. in New Jersey in February 2014 due to passing excessive gas and took the company to federal court.

Clem filed a wrongful termination suit in September 2015, as she claimed her husband was discriminated for having flatulence problems. Clem quit from the same company on the same day her husband, Richard Cass, was fired. 

But according to the Star Ledger, her lawsuit was dismissed. 

The Star Ledger said that Cass had gastric bypass surgery in 2010 after weighing 420 pounds. After the surgery, he suffered from "extreme gas and uncontrollable diarrhea," according to the lawsuit.

Clem claimed she filed the lawsuit due to the mental and physical anguish the firing caused. 

Federal Court Judge Freda Wolfson agreed that the company had made in appropriate comments about Cass' condition, but did not create a hostile work environment. 

This was the second time a federal court shot down the case.
