Man sentenced to 4 years in prison after sexually assaulting victim at Atascadero Lake Park

ATASCADERO, Calif. — A man has been sentenced to four years in state prison after he sexually assaulted a victim in Atascadero Lake Park.

According to County of San Luis Obispo District Attorney Dan Dow, David Ebrahimi Ardebili has been sentenced to four years and six months in state prison for Attempted Sexual Penetration of an Intoxicated Victim as a felony, and simple assault as a misdemeanor.

Ardebili was found guilty by a jury on both offenses on May 17.

On June 17, 2017, a woman had separated from friends and family in downtown San Luis Obispo while visiting from out of the area. DA Dow says Ardebili observed the highly intoxicated victim walking alone and enticed her into his vehicle. He then drove her to a secluded parking area at Atascadero Lake Park where he sexually assaulted her.

Under California law (Penal Code section 667.5(c)), this sexual assault offense is not defined as "violent." Therefore Ardebili is eligible to seek early release on parole pursuant to Proposition 57 that California Voter's passed in 2016, according to DA Dow.
