BAKERSFIELD, Calif. — A 40-year-old McFarland High math teacher who is accused of having sexual intercourse with a 17-year-old male student, had unprotected sex with him for about a month, according to court documents.
Officials said Elvia Gonzalez was engaging in "unlawful sexual intercourse" with the student from September 2 to October 11.
According to a McFarland Police Officer on October 11 the student's cell phone was taken away from him after school staff observed him and another student "walking on school campus appearing under the influence." Staff also confiscated a vape pen with narcotics paraphernalia from the student, according to documents.
While the phone was in possession of school staff, one of the teacher's found a missed call and text message from Gonzalez on the student's phone. In the text message, Gonzalez reportedly asked if the student wanted breakfast.
It was later confirmed that Gonzalez was, in fact, the person the student was receiving text messages from. McFarland High's principal also took several pictures of the text conversations between the two. Documents show that some of text messages read," I need you so much I can't breathe without you," and " I'm only yours". Gonzalez also sent the student a picture of herself wearing a bra.
Officials also said that some of those text were missing because Gonzalez reportedly told the student on several occasions to delete them.
The student told McFarland PD that back in August Gonzalez offered him tutoring which led to a relationship. They began meeting up outside of school when Gonzalez would pick him up from his house in her car. The student said they would have sex in Gonzalez's car and on one occasion they had sex in her shower while her kids were away. He also told officials that they had sex at least 10 times with half of those times being unprotected.
Gonzalez was arrested on October 12.
McFarland Unified School District sent out a letter to the public stating that Gonzalez has been placed on administrative leave following accusations that she sexually abused the student.
Gonzalez is scheduled to be in court on November 20.
